Terms of Service

1. Acceptance of Terms

By accessing and using ThockFactor (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to any part of these terms, you may not use ThockFactor.

2. Description of Service

ThockFactor provides a web-based platform for uploading keyboard audio recordings and receiving deterministic acoustic analysis scores. The Service includes free and paid subscription tiers with varying usage limits.

3. User Accounts

To use ThockFactor, you must create an account by providing a valid email address and password. You are responsible for:

• • Maintaining the confidentiality of your login credentials
• • Ensuring all information you provide is accurate and complete
• • Notifying us immediately of any unauthorized account access
• • All activities that occur under your account

You agree not to create accounts for minors, use false identities, or create multiple accounts to circumvent usage limits.

4. Acceptable Use Policy

You agree not to use ThockFactor to:

• • Upload malicious, corrupted, or illegal content
• • Attempt to reverse-engineer, hack, or probe the Service's security
• • Upload files that infringe copyrights, patents, or intellectual property rights
• • Harass, abuse, or threaten other users or ThockFactor staff
• • Spam, manipulate rankings, or artificially inflate scores
• • Use automated bots or scripts to access the Service
• • Violate any applicable laws or regulations

ThockFactor reserves the right to suspend or terminate accounts that violate this policy without refund.

5. User Content & License

By uploading audio files to ThockFactor, you:

• • Retain ownership of your recordings
• • Grant ThockFactor a non-exclusive license to process and analyze your files
• • Represent that you have rights to upload and share the content
• • Agree that your display name, keyboard name, and scores may appear on the public leaderboard

Audio files are deleted after analysis. Scores and leaderboard entries are retained indefinitely for community reference.

6. Subscription & Billing

Free Tier: Users are limited to 5 keyboard analyses per calendar month. Uploads beyond this limit are blocked.

Pro Tier: Costs $9.99 USD per month. Subscriptions are automatically renewed monthly using PayPal. You may cancel anytime from your account settings-cancellation takes effect at the end of your current billing cycle.

Payment: You authorize ThockFactor to charge your PayPal account for subscriptions. Failed payments may result in service suspension.

Refunds: Subscription fees are non-refundable. However, if billing errors occur, contact us at hello@thockfactor.com for resolution.

7. Disclaimer of Warranties

ThockFactor is provided "AS IS" without warranties of any kind. We do not warrant that:

• • The Service will be uninterrupted or error-free
• • Scores are scientifically "correct" (they are deterministic but not validated against human perception)
• • The Service will meet your specific needs
• • Third-party integrations or links are reliable

To the fullest extent permitted by law, ThockFactor disclaims all implied warranties, including merchantability and fitness for a particular purpose.

8. Limitation of Liability

ThockFactor and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including data loss, business interruption, or reputation harm. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

9. Intellectual Property

ThockFactor, its logo, algorithms, and underlying technology are the intellectual property of Pedro Gonzalez and ThockFactor. You may not copy, modify, or distribute ThockFactor's proprietary code or algorithms without written permission.

10. Data & Privacy

Your use of ThockFactor is governed by our Privacy Policy. Audio files are processed and deleted after analysis. Your account data and scores are retained for service functionality.

11. Third-Party Services

ThockFactor uses PayPal for payment processing and Supabase for data hosting. Your use of these services is governed by their terms of service. ThockFactor is not responsible for their availability or policies.

12. Termination

ThockFactor may suspend or terminate your account at any time for violating these terms, legal obligations, or at our sole discretion. Upon termination, your right to use the Service ceases immediately, though your leaderboard scores remain publicly visible.

13. Changes to Terms

ThockFactor may update these terms at any time. Continued use of the Service after updates constitutes acceptance of the new terms. We will notify users of material changes via email or in-app notification.

14. Governing Law

These terms are governed by the laws of Puerto Rico and the United States. Any disputes shall be resolved in the courts of Puerto Rico.
